Service Agreement

2. What is not included unless we agree in writing

Fully custom landing-page design, custom web apps, point-of-sale integrations, advanced push automations, SMS or email campaigns, backend training or co-management, advertising, and additional campaigns or offers. These are available later as separate services or upgrades.

4. Revisions

The pilot includes reasonable revisions to get the page and card right within the template (wording, colours, image swaps, offer text). Structural redesigns or new templates are custom work.

5. Ownership and licence

You own your business content and graphics. We own our templates, designs, methods, and systems, and you receive the use of them while your plan is active. You give us permission to use your provided content, name, and logo to build and operate your page and cards, and to show the finished work as an example of our work unless you tell us not to in writing.

6. Wallet platforms and third parties

Wallet cards run on Apple Wallet, Google Wallet, and our pass platform provider. Their availability, display, and policies are outside our control, and a card save by a customer records that customer’s claim — final sales attribution depends on redemption or your sales data, not the save alone.

7. Messaging compliance

If messaging (push, email, or SMS) is active for your customers, you are responsible for the lawfulness of your customer communications and consents; we will operate the tools as configured with you.

8. Pausing and ending service

If a payment fails or an annual continuation is cancelled, service may pause or end after the period already paid for. Either side may end the relationship for future periods by notice in writing; amounts already charged are handled under the Terms of Service.

9. Liability

To the extent the law allows, our total liability relating to the service is limited to the amounts you paid us in the 12 months before the claim. Neither side is liable for indirect or consequential losses, or for lost profits.

10. Notices and law

Notices to you go to the email on your account; notices to us go to wayne@365digital.ca. This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
